Committing Highway Robbery to Fund Police Militarization

The militarization of local police in the United States is not being fueled just by the federal government providing military equipment, including machine guns, grenade launchers, and armored vehicles, to local police departments. The police are also funding the rise of SWAT with billions of dollars obtained through asset seizures that amount to highway robbery under the guise of law enforcement.

In an October 11 Washington Post article, Robert O’Harrow Jr. and Steven Rich offer some revealing details concerning how state and local police have raised billions of dollars since 2008 via asset seizures associated with the US Department of Justice Equitable Sharing Program that allows state and local police departments to take 80 percent of the proceeds of seizures conducted in cooperation with US government agencies. In addition, much more police revenue has been gained through asset seizures outside the program and without direct US government involvement.

Who pays the price for the police shootings that leave unarmed citizens dead or injured, for the SWAT team raids that leave doors splintered, homes trashed, pets murdered, and family members traumatized and injured, if not dead?

I’m not just talking about the price that must be paid in hard-earned dollars, whether by taxpayers or the victims, in attempting to restore what was vandalized and broken by police. It’s also the things that can’t be so easily calculated to a decimal point: the broken bones that will never quite heal right, the children’s nightmares at night, the uneasy sleep, the broken family heirlooms, the loss of faith in a system that was supposed to serve and protect you, the grief for loved ones whose lives were cut short.

Baby Bou Bou may have survived the misdirected SWAT team raid that left him with a hole in his face and extensive scars on his body, but he will be the one to pay the price for the rest of his life for the SWAT team’s blunder in launching a flashbang grenade into his crib. And even though the SWAT team was wrong about the person they were after, even though they failed to find any drugs in the home they’d raided, and even though they may have regretted the fact that Baby Bou Bou got hurt, it will still be the Phonesavanh family who will pay and pay and pay for the endless surgeries every year to reconstruct their son’s face as he grows from toddler to boy to teenager to man. Already, they have racked up more than $900,000 in medical bills. Incredibly, government officials refused to cover the family’s medical expenses.

If you see something suspicious, says the Department of Homeland Security, say something about it to the police, call it in to a government hotline, or report it using a convenient app on your smart phone.

(If you’re a whistleblower wanting to snitch on government wrongdoing, however, forget about it—the government doesn’t take kindly to having its dirty deeds publicized and, God forbid, being made to account for them.)

For more than a decade now, the DHS has plastered its “See Something, Say Something” campaign on the walls of metro stations, on billboards, on coffee cup sleeves, at the Super Bowl, even on television monitors in the Statue of Liberty. Now colleges, universities and even football teams and sporting arenas are lining up for grants to participate in the program.

What a strange and harrowing road we’ve walked since September 11, 2001, littered with the debris of our once-vaunted liberties. We have gone from a nation that took great pride in being a model of a representative democracy to being a model of how to persuade a freedom-loving people to march in lockstep with a police state.

What began with the passage of the USA Patriot Act in October 2001 has snowballed into the eradication of every vital safeguard against government overreach, corruption and abuse. Since then, we have been terrorized, traumatized, and tricked into a semi-permanent state of compliance. The bogeyman’s names and faces change over time—Osama bin Laden, Saddam Hussein and now ISIS—but the end result remains the same: our unquestioning acquiescence to anything the government wants to do in exchange for the phantom promise of safety and security.

Ironically, just a short week after the 13th anniversary of the 9/11 attacks, we find ourselves commemorating the 227th anniversary of the ratification of our Constitution. Yet while there is much to mourn about the loss of our freedoms in the years since 9/11, there has been little to celebrate.

If you don’t want to get probed, poked, pinched, tasered, tackled, searched, seized, stripped, manhandled, arrested, shot, or killed, don’t say, do or even suggest anything that even hints of noncompliance. This is the new “thin blue line” over which you must not cross in interactions with police if you want to walk away with your life and freedoms intact.

The following incidents and many more like them serve as chilling reminders that in the American police state, “we the people” are at the mercy of law enforcement officers who have almost absolute discretion to decide who is a threat, what constitutes resistance, and how harshly they can deal with the citizens they were appointed to “serve and protect.”

For example, police arrested Chaumtoli Huq because she failed to promptly comply when ordered to “move along” while waiting outside a Ruby Tuesday’s restaurant for her children, who were inside with their father, using the bathroom. NYPD officers grabbed Huq, a lawyer with the New York City Public Advocate’s office, flipped her around, pressed her against a wall, handcuffed her, searched her purse, arrested her, and told her to “shut up” when she cried out for help, before detaining her for nine hours. Huq was charged with obstructing governmental administration, resisting arrest and disorderly conduct.

Ferguson: The War Comes Home

America’s attention recently turned away from the violence in Iraq and Gaza toward the violence in Ferguson, Missouri, following the shooting of Michael Brown. While all the facts Rp Weekly Buttonsurrounding the shooing have yet to come to light, the shock of seeing police using tear gas (a substance banned in warfare), and other military-style weapons against American citizens including journalists exercising their First Amendment rights, has started a much-needed debate on police militarization.

The increasing use of military equipment by local police is a symptom of growing authoritarianism, not the cause. The cause is policies that encourage police to see Americans as enemies to subjugate, rather than as citizens to "protect and serve.” This attitude is on display not only in Ferguson, but in the police lockdown following the Boston Marathon bombing and in the Americans killed and injured in “no-knock” raids conducted by militarized SWAT teams.

The Absurd, Bureaucratic Hell That Is the American Police State

Whether it’s the working mother arrested for letting her 9-year-old play unsupervised at a playground, the teenager forced to have his genitals photographed by police, the underage burglar sentenced to 23 years for shooting a retired police dog, or the 43-year-old man who died of a heart attack after being put in a chokehold by NYPD officers allegedly over the sale of untaxed cigarettes, the theater of the absurd that passes for life in the American police state grows more tragic and incomprehensible by the day.

Debra Harrell, a 46-year-old South Carolina working mother, was arrested, charged with abandonment and had her child placed in state custody after allowing the 9-year-old to spend unsupervised time at a neighborhood playground while the mom worked a shift at McDonald’s. Mind you, the child asked to play outside, was given a cell phone in case she needed to reach someone, and the park—a stone’s throw from the mom’s place of work—was overrun with kids enjoying its swings, splash pad, and shade.

A Connecticut mother was charged with leaving her 11-year-old daughter in the car unsupervised while she ran inside a store—despite the fact that the child asked to stay in the car and was not overheated or in distress. A few states away, a New Jersey man was arrested and charged with endangering the welfare of his children after leaving them in a car parked in a police station parking lot, windows rolled down, while he ran inside to pay a ticket.

Call it what you will—taxes, penalties, fees, fines, regulations, tariffs, tickets, permits, surcharges, tolls, asset forfeitures, foreclosures, etc.—but the only word that truly describes the constant bilking of the American taxpayer by the government and its corporate partners is theft.

We’re operating in a topsy-turvy Sherwood Forest where instead of Robin Hood and his merry band of thieves stealing from the rich to feed the poor, you’ve got the government and its merry band of corporate thieves stealing from the poor to fatten the wallets of the rich. In this way, the poor get poorer and the rich get richer. All the while, the American Dream of peace, prosperity, and liberty has turned into a nightmare of endless wars, debilitating debt, and outright tyranny.

What Americans don’t seem to comprehend is that if the government can arbitrarily take away your property, without your having much say about it, you have no true rights. You’re nothing more than a serf or a slave.

The Emperor’s New Clothes: The Naked Truth About the American Police State

It’s vogue, trendy and appropriate to look to dystopian literature as a harbinger of what we’re experiencing at the hands of the government. Certainly, George Orwell’s 1984 and Animal Farm have much to say about government tyranny, corruption, and control, as does Aldous Huxley’s Brave New World and Philip K. Dick’s Minority Report. Yet there are also older, simpler, more timeless stories—folk tales and fairy tales—that speak just as powerfully to the follies and foibles in our nature as citizens and rulers alike that give rise to tyrants and dictatorships.

One such tale, Hans Christian Andersen’s fable of the Emperor’s New Clothes, is a perfect paradigm of life today in the fiefdom that is the American police state, only instead of an imperial president spending money wantonly on lavish vacations, entertainment, and questionable government programs aimed at amassing greater power, Andersen presents us with a vain and thoughtless emperor, concerned only with satisfying his own needs at the expense of his people, even when it means taxing them unmercifully, bankrupting his kingdom, and harshly punishing his people for daring to challenge his edicts.

For those unfamiliar with the tale, the Emperor, a vain peacock of a man, is conned into buying a prohibitively expensive suit of clothes that is supposedly visible only to those who are smart, competent and well-suited to their positions. Surrounded by yes men, professional flatterers and career politicians who fawn, simper and genuflect, the Emperor—arrogant, pompous and oblivious to his nudity—prances through the town in his new suit of clothes until a child dares to voice what everyone else has been thinking but too afraid to say lest they be thought stupid or incompetent: “He isn’t wearing anything at all!”
